Filed against Governor Arnold Schwarzenegger, state Attorney General Bill Lockyer and local officials, the VSDA and ESA claim the law is unconstitutional and violates First Amendment free speech rights. "It is not up to any industry or the government to set standards for what kids can see or do; that is the role of parents," said Entertainment Software Association president Douglas Lowenstein, to the Associated Press.

Expectedly, Schwarzenegger is standing behind his support of the bill, which would impose a $1,000 fine on individuals who rent or sold mature-rated videogames to anyone under the age of 18. "I believe strongly that we must give parents the tools to help them protect their children," he said in a statement picked up by the AP. "I will do everything in my power to preserve this new law and I urge the attorney general to mount a vigorous defense of California's ability to prevent the sale of these games to children."

Yeah, I don't agree with that. I mean, kids owning M rated games should be a parent decision, but fighting state laws is a bad idea. It will make people think morons like Jack Thompson are right.

truly it has always been a bad thing...and this bill won't last long. It's for certain, just like the alcohol banning this will not do any good. And it is a decision to make with your family. Just because you rented or bought a M rated game won't always mean that people will go out and do those things, it's overated...

but still it has always been a bad thing...and it'll never change...

It's a governement balance of powers thing. If they let them over step thier power even for a good cause, to regulate that kids can't get M rated games on thier own, then that will just lead to more and more powers they don't have, yet are using. It's more of a trying to regulate the government from over stepping authority and becoming to powerful.

The same thing happened a while back when the national government tried to make weapon free zones around schools, which was completly shot down, because the national government doesn't have the power to regulate something like that. Although in the end states governments did it.

So while it may be a good thing, a lot of the people saying they can't do it, are trying to prevent the government from doing things that wern't spelled out for them to do in the constitution. Even though I do agree that kids shouldn't be allowed to get M rated games. Luckily some stores are already implementing a rule to not sell M rated to games to anyone without a ID or quite clearly someone well over 18.

I think they should fight the law. This is not the governments job to prevent people from buying this sort of product. Should a kid be allowed to own Grand Theft Auto III? That is the parents decision. How many parents buy these games for their kids? Way too many. Kids don't really have the money to buy a 50 new game off the self but their parents do.

I don't agree with making a parents 'job' easier. It is another excuse to stay un-involved in their life. Get involved, spend time with them and know what they are doing.
