It's borderline, and probably pedantic to nitpick its usage, but I would tend to side with Nico. You seemed to say that the person who spoke up first is automatically the chosen one -- by default, so to speak. Now if Rantz was the person who was supposed to select the eater by some set of rules (de jure), but in practice the person who spoke up first was always the one selected, then that would be a de facto rule. It's probably technically fine grammar-wise, but "de facto" is used subtly differently, well, de facto. Generally it implies an actual, formal policy that in practice is disregarded. Not as bad as thinking soup is a drink, mind you.

Not really. "Default" seems to make more sense and is more appropriate in context. There doesn't seem to be an written/formal policy (de jure), which "de facto" is usually contrasted with (though the two terms aren't inherently mutually exclusive).
