I've always assumed it's asking if the death penalty should be applied to the most serious crimes, by which I'm assuming they mean things like rape and murder, or whether it should not be applied at all. If they were asking whether it would be applicable to less serious crimes I would assume the word "only" would be included. Also strongly disagreeing with the statement increases your libertarian score, which means it's probably asking whether it should be abolished.

And yeah, some of the questions are phrased pretty damn vaguely. The fact that they could be interpreted in a number of ways is probably part of the reason my score has varied so much over the years; how I interpret them seems fairly dependent upon my mood.
