As for 2nd degree murder, I agree, he should get it. I don't remember how far along the baby was due, but the fact that she didn't get an abortion doesn't give anyone the license to outright kill a baby.
But if we as a country will allow abortions, than I don't think we can turn around and get him for it. The baby doesn't legally exist, therefore it should not legally be a crime.
