I don't think the death penalty should be an option for cases based solely on circumstancial evidence. This case had no murder weapon; it didn't even have a cause of death. I agree that the circumstancial evidence was enough to vote guilty, but I don't think a case as flimsy as this one should invoke the death penalty. Innocent people have been executed in cases that were a lot stronger than this, after all. Life in a maximum security prison isn't fun and games, and at least gives the state the chance to right a wrongful conviction if such is the case down the line. I don't disagree with capital punishment, but I do think that the prosecution should have some hard, physical evidence backing them before they move for it.
